These Terms of Service (these “Terms”) form a legally binding agreement between you and Evolv Bio Labs (“Evolv Bio Labs,” “we,” “us,” or “our”). They govern your access to and use of this website and related pages (the “Site”) and every purchase of any product from us (each, a “Product”).

By creating an account, completing a purchase, or otherwise using the Site, you agree to these Terms and the related policies linked from our Legal hub. If you do not agree, do not use the Site.

To use the Site or purchase Products, you represent that:

• You are at least 21 years of age and have capacity to contract.
• You are a qualified researcher or affiliated with a laboratory, academic institution, or research facility.
• You are purchasing solely for in-vitro laboratory research, not for human or animal use, resale, or redistribution.
• All information you provide is accurate and will be kept current.

We may refuse service, cancel orders, or terminate accounts if we believe these representations are untrue.

All Products are intended strictly for in-vitro laboratory research by qualified professionals. They are not drugs, supplements, foods, cosmetics, or medical devices, and are not for human or animal consumption. See our Research Use Only Disclaimer.

Submitting an order is an offer to purchase. Orders are not binding until we accept them by shipment confirmation or shipment. Prices are in U.S. dollars and may change without notice. Payment is processed by third-party processors. You are responsible for applicable taxes.

Shipping terms are described in our Shipping Policy. Title and risk of loss pass when Product is tendered to the carrier, unless we agree otherwise in writing.

Cancellations before carrier handoff are governed by our Return & Refund Policy. Once Product is handed to the carrier, sales are generally final. Contact us before initiating a chargeback.

• Do not administer any Product to humans or animals by any route.
• Do not resell, relabel, or redistribute Products.
• Do not request reconstitution, dosing, or administration guidance.
• Do not make therapeutic, medical, diagnostic, or efficacy claims about Products.

You are responsible for account credentials and activity under your account. Notify us of unauthorized access. We may suspend or terminate accounts consistent with these Terms.

Site content is owned by Evolv Bio Labs or its licensors. You receive a limited license to access and view content for evaluating Products for research purposes. Unauthorized copying or exploitation is prohibited. See our DMCA Copyright Policy.

The Site and Products are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law — including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Evolv Bio Labs is not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability is limited to the greater of amounts you paid for the Product giving rise to the claim in the prior twelve months, or $100.

You agree to defend and indemnify Evolv Bio Labs and its affiliates from claims arising from your breach of these Terms, misuse of Products, unlawful use, or misrepresentations about qualifications or intended use.
